In order to use Whale Mail, you must be 18 years of age or older, and able to enter into legal contracts. You must provide true, complete, and up to date contact information. By using Whale Mail, you represent and warrant that you meet all the requirements listed above, and that you won't use Whale Mail in any way that violates any laws or regulations. Whale Mail may refuse service, and change eligibility requirements at any time.
Whale Mail operates on an automatically renewing yearly subscription model, and does not offer refunds. Your subscription period starts on the day you subscribe, and ends one year from that date. If you choose to stop using Whale Mail before your yearly subscription is up, you will not be reimbursed for that time. You must unsubscribe from Whale Mail in your account settings to prevent your credit card from being charged, and your subscription continuing.
Accounts and Passwords
You’re responsible for keeping your account name and password confidential. You’re also responsible for any account that you have access to, whether or not you authorized the use. You’ll immediately notify us of any unauthorized use of your accounts. We’re not responsible for any losses due to stolen or hacked passwords. We don’t have access to your current password, and for security reasons, we may only reset your password.
Sending Rules
All mail sent must comply with the CAN-SPAM Act: https://www.ftc.gov/tips-advice/business-center/guidance/can-spam-act-compliance-guide-business You may not send more than 1,500 messages per day. If you do not follow these rules, Whale Mail may terminate your account.
Data Retention
In the event that you end your subscription to Whale Mail, or your account has been terminated, Whale Mail may keep any data still residing on our servers for 60 days. This includes e-mails and user account information. The purpose of this data retention is to facilitate a reactivation of Whale Mail if the user chooses to resubscribe. After the 60 day period, all user data will be permanently deleted.
In the unlikely event that Whale Mail goes out of business, or is no longer able to offer services, Whale Mail will make a best effort to inform all customers one year prior to ending service.
About These Terms
We may modify these terms of service at any time. You should look at these terms regularly, and we will inform our customers of the terms change. Changes will not apply retroactively and will go into effect no sooner than 14 days. If you choose not to agree to the new terms, contact Whale Mail about terminating your account.
